New Tenancy Agreements Scotland

On December 1, 2017, a new type of rental – private residential rent – came into effect, replacing secure and short-term leases for all new leases. If your landlord uses the Scottish Government rental model, they should also give you the “Easy Read Notes” which explain the rental conditions in plain English. If your rent started after December 1, 2017 and you rent from a private landlord, your landlord must give you a package of “easy to read notes” or “support notes” explaining your rights and obligations at the same time as your rental agreement. More information about the information you should receive on the Scottish Government website. On 1 December 2017, the Scottish Government introduced a new form of Scottish residential tenancy known as Private, Residential Tenancy (“PRT”), when the main provisions of the Private Housing (Tenancies) (Scotland) Act 2016 (the “Law”) came into force. The law will apply to all new private rental units as of December 1, 2017. You and your client can send a signed rental agreement by email. You don`t need to print it. Finally, here`s the big… Withdrawal of the right to terminate on a given date: The major change of service for many lenders will be the withdrawal of the right to terminate the lease on an end date determined by the notification of a section 33 and notification of termination. The tenancy agreement can now be pursued until either the tenant terminates the tenancy agreement or the landlord can recover the property under one of the 18 specific reasons mentioned in the law.

Before or at the beginning of your lease, your landlord must inform you that you have a legal obligation to give your tenant the “simple reading notes for the private lease for private residential rents of the Scottish Government” or the Private Residential Tenant Statutory Terms Supporting Notes. The lease must be signed by all tenants and your landlord. If there are common tenants, each tenant should receive a copy of the agreement. You must complete the next challenge before you can download your rental agreement. You must provide a written copy of the tenancy terms to your tenant before the lease expires. It must be signed by both parties. These signatures may be electronic, as the new rent is not subject to the Requirements of Writing (Scotland) Act 1995. This means that you can enter your name into the document and email it. A lease agreement should also provide information: Learn more about the end of your lease. Learn more about how a landlord can end your rent. There is no need for a new AT5 every time the rent is renewed. A landlord is also legally required to give a tenant a series of notes accompanying their rental terms.

If a landlord uses the Scottish Government Model Private Residential Tenancy Agreement, a landlord must disclose this information to their tenant: You cannot charge your tenant for written rental conditions or other information that you must provide legally.
